Hon. Anamero Sunday Dekeri hires two Senior Advocates of Nigeria, Joseph Nwobike, SAN, Chief Henry Akunebo SAN and ten other lawyers to challenge the Constitutionality of the declaration of senator Monday opkpebholo as the winner of the primary and candidate of APC in the recently concluded primary election.
In a suit which he filed at the Federal High Court marked Suit No. FHC/ ABJ/ CS/ 299/ 2024, Hon. Anamero contended that as the winner of the 17th February, 2024 primary election, his right to be declared the candidate of APC for Edo state Gubernatorial election for 2024 had accrued and become vested, and that his accrued and vested Rights cannot be defeated, overridden and or extinguished by the supplementary primary election of 22nd February 2024 purportedly won by senator Monday opkpebholo .
He further contended that INEC has a duty pursuant to section 84(13) of the Electoral Act, 2022, as amended to reject the purported nomination of senator Monday opkpebholo whose nomination was done in breach of the Constitution of Nigeria 1999, the Electoral Act and the Constitution of APC and its guidelines.
In a letter by his counsel, the learned senior Advocates warned the national chairman of INEC not to accept or process the nomination of Monday Opkpebholo or any other person other than Hon. Anamero Sunday Dekeri as candidate of APC for Edo state Gubernatorial slated for September, 2024.
